These terms apply to website design projects unless a written quotation says otherwise. They are a practical small-business template—not formal legal advice.

1. How a project starts

1. You enquire (form, WhatsApp, call or booking link).
2. We discuss your needs and recommend Launch, Grow, Lead, Serve (restaurants) or a custom quote.
3. You receive a written quotation (scope, price, payment steps, timeline estimate).
4. You accept in writing (email is enough) and pay the deposit.
5. Work begins. The quotation + this agreement form the project terms.

Quotes are valid for 14 days unless stated otherwise.

2. Scope of work

Package inclusions match the accepted quote and the standard package descriptions on our pricing page (Launch, Grow, Lead, Serve or Custom — pages, features, revision rounds).

Serve (restaurant): Includes listing assistance for Uber Eats and Mr D (checklists, menu formatting, profile copy) and collection-only ordering setup as in your quote. We do not guarantee platform approval, act as merchant of record, pay platform commissions, or run a delivery fleet. Kitchen ops, food licences and banking remain yours.

Not included unless quoted: e-commerce, complex custom systems, paid ads management, ongoing SEO campaigns, large migrations, professional photography, third-party subscription fees, guaranteed marketplace listings, or delivery fleets.

Revisions: Each package includes a set number of revision rounds within scope. New pages, new features or major redesigns after structure approval are quoted separately.

Your role: Supply content and assets you have rights to use, and give timely feedback. Delays extend the timeline.

3. Timeline

A straightforward site typically takes about 2–4 weeks after required content is received and the project is confirmed. Serve projects are often about 3–5 weeks; marketplace approval times sit outside our control. Dates on quotes are estimates, not guarantees.

4. Fees, deposits and invoices

• Prices are in South African Rand (ZAR).
• Power Designs Web is not currently VAT registered; VAT is not added unless this changes and is disclosed.
• Standard payment: 50% deposit on acceptance · 50% balance before final launch / handover (unless the quote sets another schedule).
• We send a written invoice or payment request for each amount due (EFT details included).
• Proof of payment may be required before work continues or before launch.
• Payment plans, if agreed in writing, may require hosting with us until instalments are complete.
• Overdue amounts may pause work; launch and final files may wait until the agreed balance is paid.

5. Cancellations and refunds

If we cancel for reasons within our control, we refund fees paid for undelivered work, less proven third-party costs already spent for you.

6. Ownership and handover

• You keep materials you supply (logo, photos, your copy).
• After full payment: you own the custom design and content created for your project as delivered; you may use the site for your business.
• We retain our tools, methods and pre-existing materials; you get a licence to use what is built into your site.
• Domains should be registered in your name where possible.
• We may show the work in our portfolio unless you ask us not to in writing.
• Third-party tools (Google, booking apps, etc.) keep their own terms and fees.

7. POPIA and personal information

We handle personal information carefully under South African POPIA principles.

• Website enquiries: see our Privacy Policy (name, business, email, phone, message).
• Project work: we use client-supplied information only to deliver and support the project; we do not sell it.
• We may use trusted providers (hosting, email/form delivery) as needed to operate the service.
• You must have the right to share any third-party personal information (e.g. staff photos, reviews).
• You may request access, correction or deletion of your personal information, subject to legal record-keeping.

8. Quote and invoice process (summary)

1. Enquiry → we respond (target: 1 business day).
2. Short discovery → package or custom recommendation.
3. Written quote → scope, price, payment steps, validity 14 days.
4. Accept + deposit invoice → project starts on payment.
5. Build & review → revision rounds per package.
6. Balance invoice → paid before final launch / file handover.
7. Launch & handover → optional monthly support offered.

9. Results and liability

We work with reasonable skill and care. We do not guarantee Google rankings, sales results, or uninterrupted third-party platforms. Our liability for a project is limited to fees paid for that project in the preceding three months, except where South African law does not allow such a limit.

10. Support after launch

Optional monthly plans (Care, Support, Priority) are separate from the build fee. Allowances reset monthly and do not roll over unless stated on the quote.
